1. Who we are and what each party does
xtravel.cloud (the “Platform”) is a technology website that works as an advertising and showcase space for tourism offers. Independent third parties (hotels, tour operators, agencies and other tourism providers, the “Advertisers”) publish on it their own listings for circuits, hotels, rooms, places and other services (the “Listings”). Travellers can browse them and send requests, which are routed to the relevant Advertiser.
The Platform is run by [RAZÓN SOCIAL DE LA PLATAFORMA], tax ID (NIT) [NIT DE LA PLATAFORMA], address [DOMICILIO DE LA PLATAFORMA].
The Platform acts as a technology intermediary and advertising space:
- It does not provide the advertised tourism services (circuits, transfers, lodging, guides, activities).
- It is not a party to the services contract a traveller enters into with an Advertiser, unless expressly stated otherwise in a specific case.
- It does not set the prices, availability or conditions of the advertised services: each Advertiser does.
- It does not individually verify every Listing, although it applies the controls and the takedown procedure described in these terms.
The Advertiser’s identity (trade name, legal name, NIT and, where applicable, its tourism registration) must appear in its Listing or in the confirmation of your request.
2. Acceptance of these terms
By browsing, creating an account or sending a request, you declare that you have read these terms, the Privacy policy, the Cookie policy and the Request conditions, and that you accept them. If you disagree, do not use the site.
Browsing does not require an account. An account is needed only for member features, such as viewing your requests or leaving reviews.
Companies that want to publish Listings are also bound by the Advertiser terms.
3. Who can use the site
- You must be over 18 and have legal capacity to contract.
- A minor may only travel accompanied by a mother, father, guardian or legal representative, who makes the request and answers for it. The Advertiser may ask for the documentation Bolivian regulations require for travelling with minors.
- The information you provide must be true, complete and up to date.
4. Member accounts
- You can sign in with a one-time code sent to your email or with your Google account. Some older accounts still sign in with a password.
- You are responsible for safeguarding your email, your Google account and your device, and for all activity carried out with your session.
- Tell [CORREO DE CONTACTO DE LA PLATAFORMA] immediately if you suspect unauthorised use.
- You may ask to close your account at any time. The Platform may suspend accounts that breach these terms or are used for fraud or abuse.
5. Permitted use of the Platform
It is forbidden to:
- Use the site for unlawful purposes or in bad faith.
- Send false, repeated or mass requests, or use automated processes to extract content, overload the service or bypass its protections.
- Try to access accounts, systems or data of third parties.
- Impersonate another person or give someone else’s contact details without their permission.
- Introduce malicious code or interfere with the security of the site.
6. Listings and Advertisers
- Each Listing is advertising by the Advertiser. Its content (text, photographs, videos, prices, schedules, included services) is provided by and is the responsibility of the Advertiser.
- Paid or featured Listings are identified as such (for example, “Advertising” or “Featured”). The order in which Listings are shown may be influenced by that status.
- Some photographs may carry the label “indicative” (referencial): they illustrate the type of service and not necessarily the exact space or vehicle of your request.
- Information may change and may contain errors. Nothing published is, by itself, a confirmation of availability, price or service.
- Links to third-party sites (maps, messaging apps, the Advertiser’s own pages) are governed by those third parties’ conditions.
7. Requests
Sending a request on this site charges nothing and does not guarantee a place, a date or a price. The request reaches the Advertiser, who checks availability, price and payment method and contacts you. The service is contracted with the Advertiser and exists only when the Advertiser confirms it and its payment conditions are met. Details are in the Request conditions.
8. Prices and availability
- Prices are shown in the currency stated in each Listing. The applicable price is the one the Advertiser confirms in writing before payment.
- Schedules, availability and included services depend on each departure and on the Advertiser’s confirmation.
- The Platform does not collect the price of the tourism service on the Advertiser’s behalf, unless that function is enabled in the future and you are expressly informed before using it.
9. Relationship with the Advertiser and its responsibility
- The tourism services contract is entered into between you and the Advertiser.
- The Advertiser is responsible for the truthfulness of its Listing, for the availability and price it confirms, for the quality and safety of the service, for holding the permits, registrations, licences and insurance its activity requires, for issuing invoices or receipts and for handling your complaints.
- Payments, cancellations and refunds follow the policy each Advertiser publishes, as set out in the Request conditions.
- This does not limit the rights that Law 453 grants to users and consumers against those who supply them with goods or services.
10. Content and reviews policy
Listing content. Listings must be truthful, not misleading and must respect third-party rights. The detailed rules for Advertisers are in the Advertiser terms.
Reviews and other content you send. By sending a review, comment or any content, you declare that:
- It is truthful, comes from your real experience with the service and does not infringe third-party rights.
- It contains no insults, discrimination, other people’s personal data, advertising or unlawful content.
- It is not sent in exchange for a payment, gift or advantage offered by the Advertiser, nor to harm a competitor.
- You authorise the Platform to display it on the site and to make it available to the reviewed Advertiser. Your name is published only if you consent when sending the review.
Reviews are published after a check. Reviews that breach these rules may be rejected or removed, whether favourable or unfavourable. A review is not removed merely for being unfavourable. The Advertiser may reply publicly to a review but may not ask for its removal for that reason. Complaints are not published: they are handled privately under section 17.
11. How to report a false, misleading or unlawful Listing
If you believe a Listing is false, misleading, infringes rights or is unlawful, you may report it to [CORREO DE REPORTES DE LA PLATAFORMA] or through the Listing’s report link, when there is one. State the Listing, the reason and, if you can, evidence (screenshots, messages, receipts) and your contact details.
The Platform will review the report within [N] business days, may ask the Advertiser for explanations and, where appropriate, will hide or remove the Listing, suspend it or close the Advertiser’s account, following the procedure in the Advertiser terms. We will tell you the outcome if you left a way to contact you. This report does not replace your right to complain to the Advertiser or to go to the authorities.
12. Intellectual property
The site’s design, code and the Platform’s own trademarks, logos and texts belong to the Platform or its licensors. The texts, photographs, videos and trademarks in each Listing belong to its Advertiser or to third parties who authorised it, and are displayed under the Advertiser’s licence to the Platform. You may not copy, distribute or use them commercially without the owner’s written permission.
You keep ownership of what you send and grant the Platform a non-exclusive, free and revocable licence, limited to the time the content remains on the site, to display and operate it.
13. Virtual guide
The site’s guide answers with frequently asked questions. It is informational: it does not confirm requests, prices or schedules and does not replace asking the Advertiser. If answers generated by artificial intelligence are added in the future, you will be told visibly and the Privacy policy and these terms will be updated before use.
14. Responsibility of the Platform
- The Platform answers for its own obligations: operating the site with reasonable diligence, protecting your account and data as set out in the Privacy policy, handling the reports and complaints it receives and acting on unlawful Listings of which it has actual knowledge.
- The Platform does not provide the advertised tourism services, does not guarantee their quality, availability, price or outcome, and is not liable for the Advertiser’s breaches or for the content of Listings, to the extent the law allows.
- The Platform does not guarantee that the site will be free of interruptions or errors.
- Nothing in these terms limits the non-waivable rights the law grants to users and consumers, or excludes liability for wilful misconduct or gross negligence, or the liability the law attributes to the Platform. These terms will always be interpreted so that no clause is abusive.
- The Platform is not responsible for the content or services of linked third-party sites.
15. Force majeure and destination conditions
Neither the Platform nor the Advertisers are liable for breaches or delays caused by events beyond their reasonable control, such as:
- Adverse weather, storms or wind on Lake Titicaca that force crossings to be suspended.
- Road blockades, strikes, social conflicts or road closures.
- Natural disasters, health emergencies, orders of authority and public utility failures.
In these cases the Advertiser is expected to offer, where possible, rescheduling, replacing the service with an equivalent one or refunding what applies under its policy and the Request conditions.
16. Traveller responsibilities
- Carry the identity documents, visas and permits your trip and entry to Bolivia require.
- Bear in mind that the destination may be at high altitude (Lake Titicaca is about 3,800 metres above sea level) and consult a health professional if you have heart or respiratory conditions, are pregnant or have other conditions that call for it.
- Tell the Advertiser about allergies, reduced mobility, dietary restrictions and other needs before the trip.
- Take out travel and health insurance with adequate cover. Neither the Advertisers nor the Platform replace that insurance.
- Check the Advertiser’s details and pay only through the means the Advertiser gives you in its official channels.
- Follow the instructions of guides and drivers and respect natural, cultural and community heritage.
17. Complaints and user support
You may file a complaint, grievance or suggestion:
- With the Advertiser, through the channels given in its Listing or in the confirmation, and in its complaints book or equivalent channel where it has one.
- With the Platform, in writing to [CORREO DE CONTACTO DE LA PLATAFORMA] or at [DOMICILIO DE LA PLATAFORMA], or from your account if you have a request.
- In the Platform’s complaints book or equivalent channel, [UBICACIÓN O ENLACE DEL LIBRO DE RECLAMACIONES].
The Advertiser and the Platform will each answer, within their own remit, within [N] business days. If you are not satisfied, you may go to the user and consumer protection authority, or to the tourism authority, under the regulations in force.
18. Applicable legal framework
These terms are interpreted under the laws of the Plurinational State of Bolivia, in particular:
- The State Political Constitution, including the rights of users and consumers and privacy rights.
- Law 453, General Law of the Rights of Users and Consumers, including its rules on truthful advertising.
- Law 164, General Law of Telecommunications and Information and Communication Technologies, and its rules on electronic documents and commerce (Supreme Decree 1793).
- Law 292, General Tourism Law “Bolivia te espera”, and its regulations.
19. Governing law and jurisdiction
Bolivian law applies. Disputes will be submitted to the competent judges and courts of [CIUDAD DE JURISDICCIÓN], Bolivia, without prejudice to the rights the law grants consumers to go to the administrative or judicial authority that applies to them. The parties will first seek an amicable solution.
20. Changes to these terms
We may update these terms to reflect legal, technical or service changes. The date and version appear at the top. Changes do not affect requests already confirmed by an Advertiser, which are governed by the conditions in force when confirmed. If a change is significant, members will be told on the site or by email.
21. Contact
For questions about these terms: [CORREO DE CONTACTO DE LA PLATAFORMA], [TELÉFONO DE CONTACTO DE LA PLATAFORMA], [DOMICILIO DE LA PLATAFORMA].
