1. Scope and the Platform’s role
These conditions govern the requests for information or booking of circuits, hotels, rooms and other services that you send through xtravel.cloud (the “Platform”) to an advertiser (the “Advertiser”). They are read together with the Terms of use and the Privacy policy.
The Platform is an advertising space: it forwards your request to the Advertiser but does not provide the service, does not confirm the booking and does not set prices or policies. The contract is between you and the Advertiser. The Advertiser’s identity (name, legal name, NIT and, where applicable, its tourism registration) appears in its listing and in its confirmation.
2. A request is not a confirmed booking
- You choose a listing, a desired date, the number of people and, if applicable, a room type, and send the request.
- Sending it charges nothing and does not guarantee a place, a date, a price or a room.
- The request reaches the Advertiser. A person at the Advertiser checks availability, price and payment method and writes to you through the means you gave (email, phone or WhatsApp).
- The booking is confirmed only when the Advertiser tells you in writing and, if required, you have completed the payment or deposit indicated.
- If the Advertiser cannot handle the request, it must tell you and no charge is made.
You can see the status of your request in My trip if you signed in with your account. The reference code you receive identifies the request but is not a confirmation.
3. Each Advertiser’s own policy
Each Advertiser sets and publishes its own conditions for payment, deposits, cancellation, changes and refunds, and must show them clearly in its listing or, at the latest, in its confirmation and before you pay. Those conditions are part of the contract between you and the Advertiser. Read the Advertiser’s policy before paying.
The Advertiser’s conditions may not be abusive or waive rights the law grants consumers. If what the Advertiser told you before contracting is more favourable than what its policy says, the more favourable one for you prevails.
4. Minimums if the Advertiser publishes no policy
If an Advertiser has not published its cancellation or refund policy, and until it communicates one in writing before payment, these rules apply as a minimum, which the Advertiser accepts by publishing on the Platform:
| Notice before the service starts | Refund of the amount paid |
|---|---|
| [N] days or more | [PORCENTAJE] % |
| Between [N] and [N] days | [PORCENTAJE] % |
| Less than [N] days | [PORCENTAJE] % |
| No-show without notice | [PORCENTAJE] % |
- Deposit to confirm: no more than [PORCENTAJE] % of the total price. Balance: no later than [N] days before the service starts, unless the Advertiser states another date in writing.
- If the Advertiser cancels or substantially changes the service, you may choose, without penalty, between rescheduling, accepting an equivalent or better service, or receiving a full refund of what you paid for the service not provided. If the cause is not force majeure, the Advertiser is also liable under the law.
- Refunds are made through the same payment method used, unless agreed otherwise, within [N] business days of approval.
- Only costs the Advertiser has itemised and the law allows may be deducted.
5. Prices, currency and taxes
- The listing price is shown in its currency and is indicative until the Advertiser confirms.
- The Advertiser must confirm in writing the total price, the currency, which taxes and charges it includes and how to pay.
- If an obvious error is found in a published price, the Advertiser must tell you before confirming, and you may keep the request at the correct price or withdraw at no cost.
- If you pay in a currency other than the listing’s, the Advertiser must state the exchange rate applied before charging. Bank fees of your payment method are for your account, unless agreed otherwise.
6. Payment
- The Platform does not collect or process payments for the service, unless that function is enabled in the future and you are expressly informed before using it.
- Pay only to the accounts or people the Advertiser gives you through its official channels, in the name of the Advertiser identified in its listing. If in doubt, check with the Advertiser and report any suspicious charge to the Platform.
- The Advertiser must issue the corresponding receipt or invoice under Bolivian tax rules.
- If payment is not completed within the stated period, the Advertiser may release the places and treat the request as cancelled, notifying you.
7. What each service includes
What each service includes and excludes is what appears in the listing and in the Advertiser’s confirmation. Anything not expressly included is for the traveller’s account. Itineraries may be adjusted for safety, weather or operations, keeping the essential content of the service.
8. Changes requested by the traveller
You may ask to change the date, number of people or room, subject to availability and to the Advertiser’s policy, which will tell you in writing whether it applies and whether it involves a price difference or a fee.
9. Groups and minimum participants
Some services require a minimum number of participants. If it is not reached, the Advertiser must give notice in the time its policy states (at least [N] days) so you can choose a date change, an alternative service or a full refund. Large groups may have particular conditions, confirmed in writing.
10. Minors
- Minors travel accompanied by their mother, father, guardian or legal representative, or with the authorisation Bolivian regulations require.
- Whoever makes the request declares having authority over the minor. Always state the number of children and their ages in the notes, because different rates, rooms or safety limits may apply.
- The Advertiser may refuse a minor’s participation in an activity that is not safe for their age.
11. Documents, health and insurance
It is for the traveller to carry valid identity documents, visas and permits, to tell the Advertiser about health conditions or special needs before the trip, to consider the destination’s altitude and to hold travel and health insurance. The Advertiser is not liable for the inability to travel due to documents or health requirements not met by the traveller, except as the law provides.
12. Force majeure, weather and blockades
Lake crossings may be suspended due to wind or storms, and transfers due to road blockades or other events beyond the Advertiser’s control. In those cases the Advertiser is expected to offer rescheduling, an equivalent service or a refund of what was not provided, under its policy and the law. Additional lodging or transport costs caused by force majeure delays may fall on the traveller if they were not included.
13. Complaints and the Platform’s role
- First with the Advertiser. If something does not go as agreed, tell the Advertiser or its guide as soon as possible so it can be fixed during the service, and then file your complaint through the channels in its listing or its complaints book. Keeping photographs, receipts and messages helps to resolve it.
- With the Platform. If the Advertiser does not answer or you are not satisfied, you may write to [CORREO DE CONTACTO DE LA PLATAFORMA] or from My trip. The Platform will forward your complaint to the Advertiser, ask for a reply within [N] business days, may mediate voluntarily between the parties and will tell you the outcome.
- Scope. The Platform is not a party to the service contract and, as a general rule, is not obliged to refund or provide third-party services. This is without prejudice to any refunds or liabilities the law attributes to the Platform in the specific case and to anything the Platform itself has promised in writing.
- Measures against the Advertiser. Well-founded complaints may lead the Platform to warn, suspend or remove an Advertiser under the Advertiser terms.
- If you are not satisfied, you may go to the user and consumer protection authority or to the tourism authority, under the regulations in force. The general channels are in the Terms of use, section 17.
14. Right of withdrawal
Bolivian consumer and e-commerce rules may recognise withdrawal periods in certain cases. For tourism services with a fixed date, the cancellation rules of the Advertiser’s policy apply, without prejudice to the rights the law grants you.
